Topbreed Productions Terms and Services Agreements
PRICING AND PRODUCT & SERVICES AVAILABILITY- Once you’ve received our quote, it’s up to you to pay the deposit that ensures product and/or service availability on your event date. You have 3 days before the quote is invalid. If you are using our online rental booking, you will be required to pay the security deposit to reserve and hold any of your items for your event date. If you are requesting services other than product rentals, we will send an email quote or an invoice for the additional services requested. Rental prices online only include product rentals. Delivery, setup, decoration, wedding services are additional fees. All rental and event service prices are non-negotiable. Requesting a quote does not guarantee a reservation. Any changes or additions to your order will require an additional fee.
REQUIRED DEPOSIT + PAPERWORK- Rental products and all event services require a signed copy of our rental agreement or service agreement and payment of the deposit stated on invoice. Final payment is due thirty days (30 days) prior to the event. Some items may be ordered or customized just for your order. Orders may not be changed within eight weeks of your event. Orders placed less than 30 days from the event date require full payment upon order placement to reserve your rental or services requested.
DELIVERY/ SETUP + PICKUP-- If delivery + setup services are requested and paid for, we’ll deliver and set up the rentals prior to your event’s start time. If there is a specific time required for delivery and setup, this must be agreed upon at least thirty days in advance. Delivery fees FOR RENTAL PRODUCTS start at $50.00 and vary depending on distance. Delivery fees will be discussed during the quoting process, and any fees will be included in all official quotes and contracts. Delivery includes drop-off on the day unless stated otherwise. Pick up will be the same day before 9pm unless otherwise stated. Times outside of 10am-9pm are subjected to additional charges. If items are not available or accessible upon pick-up, another day’s rental fee will be charged (1/2 of rental price paid). Delivery and pickup only items will be made to a dock, garage, or door that is readily accessible to our trucks. At the time of pick-up all rental items should be stacked in the same place and manner in which they were delivered. All items should be boxed up as they were when received or additional fee 1/2 of rental price will be charged for packing up of items. Deliveries made to locations that are not easily accessible will require an additional charge.
For an additional charge we do offer decorating services that will take care of setup, teardown, cleaning and packing up rental items.
Delivery fees are assessed based on a two-trip basis (one to deliver and one to pick up) meaning we have to make the drive four times. Delivery fees will be stated in the invoice as well as agreed upon times. Times must be set up 30 days prior to the event. If additional trips are required, you will automatically be billed an additional $100 trip fee (or additional $ if mileage is over 60 miles) will be charged, regardless of fault. If your ceremony and reception are in two separate locations, additional delivery fees will apply. If items are not available within three (3) days, replacement fees will be assessed on top of the late rental fees charged; there will be no refunds or exceptions.
Note: We do not install or decorate with items that were not provided by us. unless we have specifically agreed upon this in the contracting of our decorating services pricing. The set up and breakdown do not include the cleanup of items that are not the property of Topbreed Productions. Upon pick up or delivery, if Topbreed Productions perceives that misuse will occur with our rentals, we will NOT leave the items and no refunds will be issued.
CUSTOMER PICKUP- WILL-CALL of rental items at Topbreed Productions business location- Most, but not all, of our rental items are available for pickup and return to our business location. All customer pickups must be made by the time chosen on your invoice and must be returned by your time selected at checkout. Additional charges will be assessed for items returned late.
Late Fees of Rental Items: 1 day late= 1.5 % of total rental , 2 days late= 2.0 % of total rental, 3 days late = a replacement charge. Item replacement charges can be up to or over 500% of rental fee.. prices vary per rental product. Replacement fees will be assessed and charged to the credit card on file.
DAMAGED/MISSING ITEMS- The renter assumes full responsibility for the item upon its possession and agrees to pay the full replacement cost for any lost or damaged items. Items should remain in “Like New” condition. Buyer is aware that these are previously used rental items, and items may have some use or small imperfections due to previous rentals. Excessive dirt, mud, food/beverage stains or markings will be assessed and subject to additional fees or a replacement fee if marks will not come out of the rental item and renders the item to be removed from future rentals. All florals or fragile items should be handled with care to prevent breaking or mis-shape of items. Take caution with items when traveling and stacking boxed items so boxes & items are not damaged. If you choose to take a chance on the weather and hold an outside event, the client accepts full responsibility for wind and weather damage. Items should not get wet for any reason or the client will be responsible for replacement cost. No rearrangement of florals is allowed, all florals must be remain in the same condition as they were received and have no missing florals from the arrangement, or broken stems.
Customer Responsibility: Communication is important. Items could be scheduled for another rental three days after your event. Should any accident happen, please inform me as soon as possible so that I may make arrangements for the next event. Complete responsibility for rented items remains with the customer from time of delivery/pick-up to the time of return. Costumer resumes all liability of risks and responsibility of use of products from the time items are picked up, until the return time of the products.
WEATHER CONDITIONS/ACTS OF GOD - Topbreed Productions does not issue refunds for any reason, including inclement weather or acts of God. The client assumes all risks and hardships involved with having an outdoor event. Please discuss “Plan B” with your coordinator. Note: “Plan B” is a requirement for us and will be discussed beforehand if you obtain our company for any type of services. Topbreed Productions is not responsible for revising your event the day or two prior to your event, should inclement weather be ensuing. It is our desire that your event go as smoothly as possible. If you choose to take a chance on the weather, the client accepts full responsibility for wind and weather damage. If Topbreed Productions arrives for delivery/setup and the weather is bad or impending, we will call you or a contact person to discuss “Plan B.” If you will be unavailable on the day of your event, please provide an alternate contact name and phone number.
PAYMENT TERMS- A valid credit card must be kept on file. The credit card will be used for damages, missing items, late fees, replacement fees, cleaning fees, or added services as outlined above. The credit card will be charged if changes are made the day of the event, such as addition of extra services, labor, or additional items that are requested or required. Late payments—any payment not received in our office thirty (30) days prior to the event date will be considered late. Late payments will be subjected to an additional fee of $30 each day.
NO REFUNDS- No Refunds: All sales are final, and the Company does not offer any money-back guarantees. You recognize and agree that you shall not be entitled to a refund. No refunds are given if the desired object you have chosen is not exactly what you had pictured in your head. Clients are expected to inspect each item for damage and design of the item upon pickup. Customer must note any discrepancies/objections due to damage at the time of pickup or delivery. No exceptions are made to this rule. If you choose to forgo the inspection of items, you do so at your own risk and assume responsibility for each item without prior inspection.
PAYMENT FOR DAMAGED/MISSING ITEMS- Topbreed Productions will notify you within 5 days of the event if damages are discovered, or items are found to be missing upon sorting and counting. Photos of the damages will be submitted as proof upon request. If damaged items are not paid for within 7 days, the credit card on file will be billed, unless payment arrangements have been made. All payments for damages should be made within 10 days. Please respect our business and let us know as soon as possible if there is any type of damage.
ORDERS + SERVICE CHANGES- Any order or service changes must be made in writing or via email to avoid any confusion. A detailed invoice will be submitted following any changes to your order by email. Additional services require an appropriate deposit and will be charged to your credit card unless other terms are specified. Emails are considered legal and binding and do not require a signature to be valid. If changes are made the day of the event, a responsible party must sign for them upon agreement and/or delivery of items or services, and pay with cash, or the credit card will be billed automatically. Additional additions are allowed with a 30-day notice. No substitutions are allowed within sixty (60) days of the event. Any changes prior to the 60 days, may be allowed based only on availability of item or services requested.
Rental orders may be canceled at any time; however, due to high rental demand & services demands, there are no refunds on cancellations. Cancellations will result in forfeiture of the total amount of payments made to date. If amount costumer has previously paid does not equal 50% of order, orders canceled are subject to a minimum 50% cancellation fee, even if the credit card payment has not been processed. With reasonable notice at our discretion, we are glad to adjust your event date if you need to reschedule and we have no conflict with dates, services, or rentals. Professional services that have cancelations after contracts are signed must still pay full amount of contract services if cancellations are made less than 60 days of event. We do this because we have your day reserved for you, and turn down other bookings because we have you scheduled for that time. Most people do not do bookings less than 60 days to the event day and we would therefore, be unable to schedule another booking.
TERMINATION OF CONTRACT- The Contract ends on [contract end date] unless one of the parties ends the contract before that time. If one of the parties chooses to end the Contract prior to Project/Event completion, the Client is responsible for paying for all work and costs incurred up until that date. Please be aware that once the deposit is made and your event date is scheduled, all other clients have been refused your specific rentals and services for your event date, and thus all payments are non-refundable. Non payment of final payment & security deposit that is due 30 days prior to event date will result in forfeiture of rentals or services.
PHOTOGRAPHY RELEASE- This agreement gives Topbreed Productions permission to use the photos that we take at your event on our website and in advertisements, materials, social media posts, etc., with the understanding that you will not profit from them in any way.
NON PAYMENT/ BREACH OF CONTRACT- No services contained in this contract will be rendered, delivered, or made available if the balance is not paid in full prior to your event. The last day to remove items from your order is 60 days prior to your event, and without any refunds for cancellations of items. The following circumstances are considered a breach of contract:
If payments are not received by the due date and the credit card on file becomes invalid, expires, or we are unable to authorize it, your non-payment will be considered a breach of contract, and all previous payments are forfeited. If payment is not received in a timely manner, Topbreed Productions will consider your rented items and services are now available for another client’s use. Topbreed Productions is not contractually obligated to accept payments beyond the due date or refund previous payments. We will schedule another client’s event on your event date if we have been unsuccessful in contacting you or obtaining a response from you regarding payment. We will attempt to contact you using all available phone numbers and email addresses. You will NOT receive a notice in the mail. We understand that some things happen that are out of your control, and we will work with you if you experience difficulty. It is possible to modify your contract, but it must be approved by Topbreed Productions. However, all payment is required prior to event. Communication with us is key!
MISUSE OF ITEMS- Upon pickup or delivery, if Topbreed Productions perceives that misuse will occur with our rentals, equipment, or services, we will NOT leave the items and no refunds will be issued.
ORDER TERMS + CONDITIONS
Orders placed are subject to a minimum of 50% cancellation fee and lose of all money paid to date, even if the credit card payment has not been processed. Final selections, counts, and cancellations must be received no later than 60 days prior to the event. ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. All rentals require a 25% non-refundable deposit that will be charged at booking and a 50% payment of invoice. The other money owed will then be applied to your final bill. Payment may be made at any time prior to 30 days to event date.
Once 50% deposit (and a security deposit for rental items) is paid you will be added to the calendar and the date, rental items, and/or services will be reserved. Final payment for the rental must be made 30 days before the listed event date. Our décor that we set up in our decorating services cannot be moved after setup. If items need to be moved please contact us. (Move requested by client may add an extra charge.) Any damages made to the rental property, lost, or stolen inventory must be paid for by the client party. Each rental event will be supplied with an emergency kit for extra clips, etc. that may be needed. Some items may require power or batteries. There must be an available power source. We do have a few candles that are waterproof and can withstand moderate rain., however, most rental items, sound equipment, and lights cannot be exposed to moisture or any type of rain/water. We cannot control the weather so please have an indoor back up plan. There will be no refund for anything weather related including heavy wind.
Topbreed Productions LLC Liability Release Rental equipment has been received in good condition and will be returned in the same condition (ordinary wear and tear accepted).
Customer assumes all responsibility for injuries to persons, or damages to property, any and all accidents that occur, and agrees to release and hold Topbreed Productions harmless for any and all claims, of whatsoever nature, arising out of use of the rental equipment or any services provided by Topbreed Productions, while in his/her custody or any type of event being held by costumer where services are recieved. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, Customer hereby agrees to a limit on any damages claimed by Customer to the total paid to Topbreed Productions for the rental or for the services provided. Customer agrees to Topbreed Productions company right to enter premises of customer at any time to repossess said equipment. Customer agrees not to loan, sublet or otherwise dispose of rental or sound equipment. lights, or other property provided by Topbreed Productions, or use it at any other location.
Customer agrees to pay in full the replacement cost, including labor or travel fees for all damages to any of Topbreed Productions equipment or other property belonging to Topbreed Productions. If the equipment is lost, stolen, or damaged beyond repair the renter agrees to pay $XXXX.XX -the replacement cost and other lose of money is it interferes with another event where the service and/or item was being used.
THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED. The person/s or organization renting this Equipment or paying for any service from Topbreed Productions will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the conditions as above. I am aware that while in my care I am
fully responsible for the equipment and will pay for any loss or damages that may occur. I the costumer, am aware that while services are provided at my event, I, the paying costumer, am fully responsible for any and all things that happen at my event ( accidents, injuries, or death), and I the costumer will pay for any loss or damages that may occur at my event. I will hold Topbreed Productions and staff harmless for all occurrences.
PERSON ASSUMING RESPONSIBILITY will sign they hold Topbreed Productions, it's owners, and staff harmless due to any accidents, injuries, or death for any reason.
